Former Philippine Leader Rodrigo Duterte Slated for ICC Pretrial Hearing in The Hague Following Health Review

Former Philippine President Rodrigo Duterte is scheduled to make his first public appearance in more than twelve months on Wednesday, as he attends a critical pretrial session at the International Criminal Court in The Hague. The 81-year-old former leader is facing international prosecution over his central role in thousands of violent deaths during a contentious anti-narcotics campaign carried out across the Philippines.

Presiding Judge Joanna Korner signaled the expectations of the international tribunal earlier this year, emphasizing that the court expects Duterte to be physically present in the Netherlands unless an unforeseen medical condition prevents his participation. The hearing marks a major procedural milestone for the court as it prepares to move forward with a formal trial later this year.

Wednesday’s proceedings are primarily focused on managing the disclosure of key evidence between the prosecution and the defense, alongside establishing a definitive calendar for the trial itself. The full international trial against the former head of state is formally slated to commence this November.

During preliminary sessions held in June, Duterte’s principal legal representative, Peter Haynes, assured the judicial bench that the former president was entirely cognizant of the court's expectations. Haynes confirmed to the presiding judges that his client understood the tribunal anticipated his in-person presence in the courtroom at the earliest possible juncture.

The path to the Hague courtroom has faced significant procedural delays since Duterte was initially placed under arrest in March 2025. Although international jurists had initially arranged for him to face the court in September of last year, the schedule was halted after a pretrial panel granted a limited postponement to review the aging leader's medical condition.

Judges ordered that temporary reprieve to allow an independent team of medical specialists adequate time to examine whether the former president possessed the physical and mental capacity to undergo complex legal proceedings. After reviewing the medical evaluations, the court officially determined that Duterte remained legally and medically fit to take part in the pretrial phase.

The grave allegations brought against Duterte center upon his alleged involvement in numerous state-directed killings executed during his high-profile "war on drugs." The documented offenses span several years, covering his early tenure as a mayor of a major southern Philippine city through his term as president of the Southeast Asian nation. Duterte has consistently maintained his innocence and rejected all charges against him.

According to prosecutors from the International Criminal Court, systematic hit squads and law enforcement units carried out targeted killings under Duterte's direct instructions. Investigators allege that these officers and operatives were spurred to execute suspected drug offenders either by substantial financial bounties or through direct intimidation and the fear of being targeted themselves if they failed to comply.

The human toll resulting from the aggressive anti-narcotics campaign remains a subject of stark division between state records and non-governmental monitors. Official data released by the Philippine national police recorded more than 6,000 fatalities, whereas independent human rights groups maintain that the actual number of victims is drastically higher, reaching as many as 30,000 deaths.

The international tribunal has been actively probing allegations of widespread state-sponsored killings in the Philippines since 2018. Just one month after the ICC officially confirmed its preliminary examination into the brutal drug crackdowns in February 2018, Duterte responded by unilaterally declaring that the Philippines would withdraw its membership from the Rome Statute, the court’s governing treaty.

Duterte's legal team attempted to use that exit to shield him from international prosecution, petitioning the tribunal to dismiss the charges entirely on the grounds that the court lacked jurisdiction. However, judges firmly rejected the defense motion last year, writing in their formal decision that member nations are strictly prohibited from abusing their treaty withdrawal rights to insulate individuals from accountability for crimes that were already being investigated by the tribunal.

The ongoing international legal effort has also triggered intense turmoil within Philippine domestic politics. In May, an attempt by law enforcement authorities to apprehend another high-profile figure indicted by the ICC erupted into an armed confrontation within the Philippine Senate. That incident involved Ronald Marapon dela Rosa, a close ally who previously served as national police chief under Duterte and who remains a fugitive after successfully evading capture following the gunfire.

The fallout surrounding the Duterte family has further extended to the highest tiers of the current administration in Manila. Two months after the dramatic Senate shootout, the Philippine Senate convened as an official impeachment tribunal to try Duterte’s daughter, sitting Vice President Sara Duterte, on a range of serious constitutional and ethical infractions.

The vice president faces grave allegations that include the accumulation of unexplained personal wealth and the issuance of public threats aimed at the family of current Philippine President Ferdinand Marcos Jr. While Sara Duterte continues to deny any wrongdoing, an impeachment conviction would result in her permanent disqualification from holding any public office in the country.
